
With the promulgation of the Cosmetics Supervision and Administration Regulations on June 29, 2020, supporting documents of new laws and regulations related to the registration and filing of new cosmetic ingredients have been introduced, including the Measures for the Administration of Cosmetic Registration and Filing, Provisions on the Administration of New Cosmetic Ingredients Registration and Filing Data, and Technical Guidelines for Cosmetics Safety Assessment and so on.Since the implementation of the new regulations, from May 1, 2021 to November 29, 2022, a total of 45 new cosmetic ingredients have passed the filing.
Under the Regulations Concerning the Hygiene Supervision over Cosmetics (now abolished), all new ingredients were subject to approval management with the same standard. As the original approval system did not implement classified management on new ingredients and the technical review criteria is difficult to grasp, only a small number of new cosmetic ingredients have been approved for those years. From 2004 to May 1, 2021, a total of 14 new ingredients were approved.
It can be seen that under the new laws and regulations, the risk based management model of new cosmetic ingredients has greatly accelerated the process of non high-risk new ingredients passing the filing and entering the market. The 3-year monitoring period adjusts the old regulatory model, the government taking full responsibility for cosmetics safety, to the registrants independently performing the safety monitoring obligations of new ingredients, which also meets the needs of enterprises to protect technological innovation.
