On March 10, 2026, the South Korea government issued Presidential Decree No. 36176, revising the Enforcement Decree of the Cosmetics Act. This revision primarily introduces provisions related to "Cosmetics Day" activities and establishes regulations allowing relevant authorities to request necessary data and information to investigate how consumers purchase cosmetics directly from overseas. The revised decree will take effect on March 10, 2026, with Article 13, Section 2 becoming effective on April 2, 2026.
New Provisions
1. Article 3: "Cosmetics Day" Activities
This provision allows national and local governments to designate "Cosmetics Day" activities to be held weekly or monthly. During these events, individuals or organizations that have made significant contributions to cosmetics safety and industry development may be recognized and honored.
2. Article 13, Section 2: Request for Data on Overseas Direct Purchase of Cosmetics
In accordance with the Cosmetics Act, authorities may request the following information for the purpose of conducting an investigation into the status of consumers purchasing cosmetics directly from overseas:
- Information on imported items as per Article 241, Section 1 of the Customs Act, including the product name, specifications, quantity, and item number of the cosmetics.
- Consumer damage information and factual investigation results as stipulated in Article 77, Section 6 of the Consumer Protection Act.
- The name and address of the mail-order seller as per Article 12, Section 1 of the Electronic Commerce Consumer Protection Act (excluding the names and resident registration numbers of representatives or operators).
