ASEAN–Indonesia Government Regulation No. 42 of 2024 on the Implementation of Halal Product Assurance

This regulation serves as the overarching administrative legislation of Indonesia's halal certification system, with the following core elements: Halal Product Assurance (JPH) System: Products entering, circulating in, and traded within Indonesian territory are in principle required to obtain halal certificates — products made from prohibited (haram) ingredients are exempt but must be labeled "non-halal." The Halal Product Assurance Organizing Agency (BPJPH) centrally administers certification and issues/revokes halal certificates and labels. Strict separation between halal and non-halal premises: Physical segregation requirements are imposed on premises, facilities, and equipment across all stages — slaughtering, processing, storage, packaging, distribution, sales, and display (e.g., slaughterhouses must be enclosed by walls at least 3 meters high) — to prevent cross-contamination. Management of Halal Inspection Agencies (LPH): The regulation governs the establishment of LPH (by government or private/social entities), the conditions and procedures for applying for accreditation from BPJPH, the accreditation and revocation mechanisms, as well as the appointment, dismissal, and duties of halal auditors and halal supervisors. Rights and obligations of business operators and supervisory personnel: It clarifies the obligations of business operators and the supervisory duties of halal supervisors (JPH supervisors, who are civil servants). Phased mandatory implementation: Mandatory halal certification is being rolled out in phases — food and beverages, food ingredients and additives, and slaughtering products and services produced by large and medium-sized enterprises must be certified starting 18 October 2024; imported products are deferred to October 2026; and products of micro, small, and medium-sized enterprises (UMK) must complete certification by 17 October 2026. Selling uncertified products is subject to penalties such as written warnings and product removal (withdrawal) from the market.
