Recently, the Indonesia Food and Drug Authority (BPOM) has canceled the distribution permits for 21 cosmetic products. The decision was made due to discrepancies between the actual ingredients and the information declared on the product labels, indicating non-compliance with labeling regulations. CIRS reminds relevant enterprises to strictly adhere to Indonesia’s cosmetic labeling requirements, ensuring that all label information is truthful, accurate, and complete. In addition, companies need to ensure full compliance with local regulatory requirements regarding product formulations, notification data, and other relevant documentation.
Labeling Non-compliance May Pose Potential Health Risks
During the supervision, the BPOM found differences in the type of ingredients, ingredient levels, or both in several products, with most violations recorded in cosmetics produced under contract manufacturing. According to the BPOM, such discrepancies can pose health risks, such as allergic reactions in users sensitive to undeclared ingredients. In addition, a product’s benefits may not match the claims on the packaging.
The production or distribution of cosmetics that do not comply with the data violates BPOM Regulation No. 21 of 2022 concerning Procedures for Submitting Cosmetic Notifications. The BPOM has revoked the distribution permits of the 21 products and ordered the business actors to withdraw and destroy the related products. It has also reminded business actors to comply with the applicable laws and regulations, including the Guidelines for Good Cosmetic Manufacturing Practices (CPKB), and to ensure that each batch is produced according to the formula approved in the notification.
Cosmetic Labeling Requirements in Indonesia
According to the latest BPOM Regulation No. 18/2024 on labeling requirements, cosmetics sold in Indonesia must not contain any misleading information or information that deviates from the actual safety and benefits of the product. The labeling must not exploit public concern over health issues, nor may it claim to be a drug or imply any intention to prevent any disease.
The label must primarily be in Indonesian language, although other languages may be used as a supplement, provided they do not obscure or confuse the Indonesian text. The label must include at least the following information, with certain items required to be in Indonesian:
- Product name
- Function/use (in Indonesian)
- Usage instructions (in Indonesian)
- Full list of ingredients
- Country of origin
- BPOM notification number
- Name and address of the notification holder
- Batch number
- Expiration date
- Size, contents, or net weight
- 2D barcode (must include the notification number and its validity period)
- Warnings/precautions (in Indonesian)
